Terms of Use

1. Who you are contracting with

These terms govern the use of StorePackager Cloud, operated by [Your company name - TO BE COMPLETED], [Street and number], [Postcode and city], [Country] ("we"). By creating an account you accept them.

2. What the service does

StorePackager Cloud resolves apps from the Microsoft Store into a signed manifest and provides an agent that turns that manifest into deployment artefacts inside your own network. The package files are downloaded by your agent directly from Microsoft; we neither host nor redistribute them.

3. Your account

• You are responsible for the accuracy of your registration details.
• Keep your password, API keys and agent tokens confidential. Anything done with them counts as done by you. Tell us promptly if you suspect they have been exposed.
• Accounts are for organisations and their members; do not share a single login between people.

4. Acceptable use

You agree not to:

• use the service to obtain or distribute software you are not licensed to use, or to circumvent any licensing, protection or distribution restriction of a third party, including Microsoft's;
• place disproportionate load on the service, probe it for weaknesses without our written permission, or interfere with other customers;
• resell or provide the service to third parties without an agreement with us;
• use it for anything unlawful.

You remain responsible for complying with the licence terms of every application you package, and with the Microsoft Store Terms of Sale and any applicable enterprise agreement. Deciding whether you are entitled to deploy a given app is your call, not ours.

5. Plans, quotas and payment

• The Free plan is provided at no cost and with the quotas shown on the pricing page. Quotas may change with reasonable notice.
• Paid plans are billed in advance for the chosen period. Prices are exclusive of VAT unless stated otherwise.
• A paid plan runs until cancelled and can be cancelled to the end of the current billing period. We do not refund periods already begun unless the law requires it.
• If payment fails, Free plan limits may apply until the balance is settled.

6. Availability

We aim for the service to be available continuously but do not guarantee it. Maintenance, and failures at Microsoft or at our own providers, can interrupt it. No specific uptime is owed unless separately agreed in writing. Because the agent can build from a downloaded manifest without contacting us, an outage here need not stop you from deploying.

7. Your data

Data you enter stays yours. We process it to run the service, as described in the privacy policy. You can export your manifests at any time and delete your account, which removes your organisation's data except where we must keep records by law.

8. Liability

We are liable without limit for intent and gross negligence, and for injury to life, body or health. For slight negligence we are liable only where an obligation essential to the purpose of this contract is breached, and then only for the foreseeable damage typical of such a contract. Liability under mandatory product liability law is unaffected. The service is otherwise provided as is; you are responsible for testing packages before rolling them out to production systems.

9. Termination

You can delete your account at any time. We may suspend or terminate an account that materially breaches these terms, and will normally warn you first unless the breach makes that unreasonable.

10. Changes

We may amend these terms. Substantial changes will be announced by email or in the application at least 30 days in advance. If you do not accept them you may terminate before they take effect.

11. Governing law

[Governing law, e.g. German law] applies, excluding its conflict of law rules and the UN Convention on Contracts for the International Sale of Goods. Where you are a merchant or a legal entity under public law, the place of jurisdiction is [Place of jurisdiction]. Mandatory consumer protection rules of your country of residence remain unaffected.

12. Trademarks

Microsoft, Windows, Microsoft Store, Intune and Configuration Manager are trademarks of the Microsoft group. We are not affiliated with, endorsed by or sponsored by Microsoft. The service uses only publicly documented Microsoft endpoints that the Windows Update client itself talks to.
